Toronto Area Ford Dealers Association 2017 Toy Mountain Contest

 

OFFICIAL RULES AND REGULATIONS (“Official Rules”)

 

 

The “Toy Mountain” contest (the “Contest”) is sponsored by the Toronto Area Ford Dealers Association (the “Sponsor”).

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. Offer void where prohibited.

 

 

CONTEST PERIOD:

The Contest starts on November 14, 2017 at the start of regular business hours (per each Toronto Area Ford Dealer listed below) and ends on December 14, 2017 at the end of regular business hours (per each Toronto Area Ford Dealer listed below) (the “Contest Period”).

No purchase necessary.

 

Toy Donation Entry Method: During the Contest Period, visit one of the participating Toronto Area Ford Dealers/Dealerships (each a “Dealer” or “Dealership”) listed below and drop off a new unwrapped toy as a donation to the CTV Toy Mountain charity drive. For each toy donated, you will receive one ballot for entry into the Contest. Complete all mandatory fields on the ballot slip and submit it using the ballot box located at the Dealership. Personal information provided on the Contest ballot will be used for the sole purposes of administering the Contest unless an entrant elects to receive future communications from the corresponding Dealer regarding its products and/or services. One (1) entry permitted per donated unwrapped toy.

 

Cash Donation Entry Method: During the Contest Period: (i) visit www.TorontoFordDealers.ca; (ii) click on the “Toy Mountain” link located on the homepage; (iii) once on the Toy Mountain website, follow all necessary steps for completing an online cash donation; (iv) retrieve and print the official donation receipt provided by Toy Mountain (“Receipt”); (v) visit one of the Dealers listed below and present the Receipt to a sales representative. For each Receipt presented (duplicate Receipts will not be accepted), you will receive one ballot for entry into the Contest. Complete all mandatory fields on the ballot slip and submit it using the ballot box located at the Dealership. Personal information provided on the Contest ballot will be used for the sole purposes of administering the Contest unless an entrant elects to receive future communications from the corresponding Dealer regarding its products and/or services. One (1) entry permitted per separate online Toy Mountain donation.

 

No Purchase Necessary Entry Method: During the Contest Period, visit one of the Dealers listed below and test drive a new Ford model. Entrants must meet all Dealer conditions for taking a test drive. After completion of the test drive, enter the Contest by obtaining a ballot from a representative at the Dealership where the test drive is conducted. Complete all mandatory fields on the ballot slip and submit it using the ballot box located at the Dealership. Personal information provided on the Contest ballot will be used for the sole purpose of administering the Contest unless an entrant elects to receive future communications from the corresponding Dealer regarding its products and/or services. Limit one (1) no purchase necessary Test Drive entry per person, per day.

ELIGIBILITY:

The Contest is open only to legal residents of Ontario who have reached 18 years of age at the time of Contest entry.  Employees, representatives, and agents of Ford Motor Company of Canada, Ltd. (“Ford”), Ford’s dealers, the Sponsor, and each of their respective parent and affiliated companies, Contest suppliers and judges (where applicable), all coordinating agencies for the Contest and immediate family members of any such person (regardless of where they live) or those with whom any such persons are domiciled are not eligible to enter the Contest. Entries are limited to individuals only; commercial enterprises and business entities are not eligible to enter the Contest.

 

PRIZES:

Five (5) prizes will be awarded in Ontario consisting of:

·          one (1) new 2017 Mustang V6  Coupe (the “Grand Prize”) (approximate retail value of the Grand Prize is CAD $33,040, including costs for freight, air tax, select dealer chosen upgrades, dealer preparation, fuel fill charge, dealer administrative charges, and sales taxes); and

·          four (4) $1,000 secondary cash prizes.

 

The winner is solely responsible for any and all other incidental costs, expenses, and taxes which are not specifically referred to herein as part of the Grand Prize description above, including but not limited to: licensing, insurance, registration, gas consumption tax, and all other costs incurred in claiming, registering or using the Grand Prize. The Grand Prize winner will not be entitled to any difference between actual and approximate retail value of the Grand Prize.

 

The winner of the Grand Prize must take delivery of the Grand Prize from a Dealership that is close to his/her residence and designated by the Sponsor (the “Delivery Site”). The winner should allow reasonably sufficient time after receipt of the fully executed Declaration of Eligibility and Liability and Publicity Release by GTB Agency and the Sponsor for notification that the Grand Prize is at the Delivery Site for pickup (“Delivery Notice”). The winner of the Grand Prize must take possession of the vehicle within 30 days of such Delivery Notice or the Grand Prize will be forfeited and there will be no liability of the Sponsor in the event this occurs. The winner of the Grand Prize shall bear any risk of loss or damage to the vehicle after it has been delivered to the Delivery Site.

 

The winner of the Grand Prize must have satisfactory proof of insurance in order to take possession of the Grand Prize vehicle.

 

Prize may not be exactly as shown in Contest related publicity materials.

 

RANDOM DRAW AND CERTAIN RESTRICTIONS:

Five (5) Grand Prize finalists (each a “Finalist”) will be selected via random draw from among all eligible ballots received during the Contest Period. The drawing will be held at 60 Bloor Street West in Toronto, Ontario at 5:00 pm (ET) on December 15, 2017 by GTB Agency. The selected entrants will be notified by phone within 24 hours of the draw.  By completing the entry ballot, an entrant agrees to be notified that he/she is a Finalist via the phone number provided on the entry ballot. If a selected entrant cannot be contacted, for any reason, within 24 hours of the first attempt to contact, is unable to attend the Grand Prize winner determination event on December 20, 2017, starting at or about 6:00 pm (ET), at a location in the Greater Toronto Area to be determined at a later date (the “Winner Event”), or fails to return a Publicity Release form prior to the Winner Event, the Sponsor will select an alternate Finalist from all remaining eligible ballots. Odds of being selected as a Finalist are solely dependent on the total number of ballots received during the Contest Period. Odds of winning the Grand Prize as a finalist are 1 in 5. Odds of winning a secondary cash prize are 4 in 5.

 

The five (5) Finalists will be required to appear at the Winner Event for Grand Prize winner determination. At the Winner Event, each of the five (5) Finalists will have their full legal names written onto a piece of paper which will then be folded and placed into a Christmas stocking. During the one (1) hour live broadcast for the Winner Event, a CTV personality will randomly draw one (1) name at a time from the stocking. The first four (4) names drawn from the stocking will each be a $1,000 secondary cash prize winner. The fifth and final name drawn from the stocking will be the Grand Prize winner.

 

WINNER CONDITIONS:

In order to be declared the Grand Prize winner, the Finalist whose name is drawn from the stocking last must first: (i) have complied with, be in compliance with, and continue to comply with the Official Rules; (ii) correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered by GTB Agency at the Winner Event; and (iii) sign and return a Declaration of Eligibility and Liability Release form within a specified period of time. If the Grand Prize winner fails to comply with any Contest requirement outlined in these Official Rules, the Sponsor reserves the right to select an alternate winner by randomly selecting from among the four (4) secondary cash prize winners.

 

In order to be declared a secondary cash prize winner, the first four Finalists drawn from the stocking must first: (i) have complied with, be in compliance with, and continue to comply with the Official Rules; (ii) correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered by GTB Agency at the Winner Event; and (iii) sign and return a Declaration of Eligibility and Liability Release form within a specified period of time. If a secondary cash prize winner fails to comply with any Contest requirement outlined in these Official Rules, his/her prize will be forfeited with no further obligation or responsibility on the part of the Sponsor. Each secondary cash prize will be distributed in the form of a cheque for $1,000 that will be mailed out to each secondary cash prize winner within 24 hours following the receipt of the executed Declaration of Eligibility and Liability Release by the Sponsor or a designated representative of the Sponsor.

 

PRIZE SUBSTITUTION:

The Grand Prize (or portions thereof) is non-exchangeable, non-transferable, non-refundable, has no cash surrender value and must be accepted as awarded with no substitutions.  The Sponsor reserves the right, at its sole discretion, to substitute the Grand Prize with another vehicle of equivalent or greater value or of a different model year for any reason including, but not limited to: production delays caused by labour disruptions, part shortages, adverse weather conditions or other unforeseen events, or any other reason. The winner must accept all colour, interior, and option choices for the Grand Prize, as selected by the Sponsor in its sole discretion.

 

PUBLICITY:

By attending and participating at the Winner Event, each Finalist agrees that the Sponsor and its respective designees may use the Finalist’s name, photograph, likeness, city of residence, biographical information, prize information and/or statements about this Contest for advertising and/or publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without compensation, notification, or permission, unless otherwise prohibited by law.

 

GENERAL CONDITIONS:

All federal, provincial and local laws and regulations apply. By entering the Contest, each entrant agrees: (a) to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Contest, and (b) to release and hold harmless Ford, the Sponsor and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, representatives and all others entities associated with the development, execution and administration of the Contest, and each of their respective directors, officers, employees and agents (collectively, the “Released Parties”) from any and all liability whatsoever from injury, loss, death or damage of any kind resulting from participation in the Contest and/or from acceptance, possession, misuse or use of any prize.

 

PERSONAL INFORMATION COLLECTED:

By completing and submitting the information requested for participation in the Contest, an entrant consents to the collection, use, and disclosure of his/her personal information by the Sponsor and their agents and representatives for the purposes of (i) their internal use to facilitate administration of the Contest, (ii) if an entrant has so elected, to allow the Dealer where the entry ballot was received to provide the entrant with information regarding that Dealer’s products and/or services. Entrants who opt-in to receiving future communications may revoke this consent at any time by contacting the Dealer where he/she submitted his/her Contest entry ballot.

 

TAMPERING:

Released Parties are not responsible for any late, lost, delayed, stolen, misdirected, unreadable, incorrect, inaccurate, garbled, or unintelligible ballots, regardless of the method of submission, including the failure to send a prize notification to the winner; whether caused by any of the equipment or programming associated with or utilized in the Contest or otherwise, and the Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission of any equipment or programming related to the Contest; or for communications line failure; or for theft or destruction, tampering, or unauthorized access to entries and/or entry information; or for printing, human, typographical or other errors in any Contest material or the administration of the Contest; or for any telephone line, computer, software, Internet Web site or electronic defect, error or failure regardless of reason.

 

The Sponsor reserves the right, at its sole discretion, to disqualify any individual it deems to be tampering with the operation or administration of the Contest; to be acting in violation of the Official Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any person participating in or connected with the Contest. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different identities, or any other methods will void that participant’s entry and that participant may be disqualified. Use of any entry method other than that which is provided in these Official Rules to participate in the Contest is prohibited and will result in disqualification.

 

MODIFICATION OR TERMINATION:

Subject to applicable law, the Sponsor reserves the right to cancel, terminate, modify or suspend the rules or administration of this Contest, in whole or in part, without prior notice with no obligation or liability, including if for any reason the Contest is not capable of running as planned, whether due to infection of computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failure or other failures that in the Sponsor’s sole opinion corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest. In such event, a winner may be selected by randomly drawing from among all eligible ballots received up to the time of cancellation, termination, suspension or modification.

 

CONSTRUCTION:

This Contest and its Official Rules shall be governed by Ontario law and all entrants expressly agree that the Ontario courts shall have sole jurisdiction over any dispute or litigation arising from or relating to this Contest and agree to submit to the laws of and the jurisdiction of the federal courts of Canada and provincial courts of the Province of Ontario, and hereby waive the jurisdiction of any other court that now or in the future could be considered competent for any reason. The venue shall only be Toronto, Ontario. Contest entrants further hereby waive any right to a trial by jury with respect to any lawsuit or judicial proceeding arising from or relating to this Contest.
